    本研究は、裁判所が法的判断及び憲法判断を行う際のルールを、日本国憲法の解釈論として提示するものである、司法権論及び憲法訴訟論のこれまでの議論を発展させ、これを、実はこれまでの憲法学が研究と検討が不十分であったと思われる、憲法31条以下などで保障されるとされてきた適正手続、身体的自由などに及ばせ、特にそれらの司法審査基準がどうなるのか、その展開と示唆するものが何を検討し、これにより、人権論と憲法訴訟論を全面的に連結することが狙いである。アメリカ合衆国憲法修正４条、５条、６条、14条などの連邦最高裁判例の分析も行うが、それらを踏まえつつも、あくまでも、日本国憲法の下での裁判所のにおける、刑事手続条項等の司法審査基準等を解明し、憲法解釈の理論的精密化を図り、実務的要請に応えることを目的とする。

    本研究は、裁判所が法的判断（原告適格、訴えの利益、統治行為論など）及び憲法判断（憲法判断に進む要件、憲法判断の際の基準、憲法判断の方法など）を行う際のルールを、日本国憲法の解釈論として提示するものである。芦部信喜、佐藤幸治に始まる司法権論及び憲法訴訟論を踏まえ、また、最近のドイツ流の三段階審査を参照はするが、特定の比較対象国の理論に拘泥することなく、あくまでも、付随的違憲審査制を採り、憲法裁判所を有さない日本国憲法の下での裁判所の在り方について、理論的精密化を図り、実務的要請に応えることを目的とする。
