    追及権の日本法への導入を考えるとき、これまで、各国でどのような形で導入されてきたかの再検討が必要となる。2021年度は、本研究の土台となる背景についての検討を行った。
    研究代表者小川明子は、コロナ禍で1年間延期されていた著作権法学会での報告の機会を得、2021年5月22日に「日本版追及権導入の可能性」をテーマに報告を行った。本報告では、追及権の成立から現在の状況に至るまでの沿革について述べている。現在、追及権の議論は、世界所有権機構（WIPO)の著作権等常設委員会（SCCR)を中心として行われている。SCCRの任命した専門家によるタスクフォースが、導入に係る論点と追及権に関する正当化事由について報告書を出しており、本講演では、この分析及び日本で導入すべき理由付けについて述べた。研究代表者は、本報告をもとに、著作権法学会発行の「著作権研究」誌に、「追及権の正当化根拠ー日本版追及権導入の可能性ー」を執筆した。本誌は、2022年4月に発行予定となる。
    研究協力者末宗達行は、イギリス法の研究を担当している。2021年10月には、山口大学国際総合科学部及び知的財産センター共催の知的財産判例セミナーにおいて、「付随対象著作物の利用に関する権利制限～応用美術の論点に照らして～」をテーマに、日本法とイギリス法を比較の上、応用美術の論点からの講演を行った。論文としては、「応用美術の『写り込み』をめぐる一考察―イギリス法との比較を通じた、著作権法30条の2の解釈の検討―」（１）」及び「同（２・完）」が『早稲田法学』誌97巻4号等に掲載が決定しており、2022年7月以降に順次刊行予定となっている。

    本年度は、研究計画調書記載のように、法学チームとデザイン学チームのそれぞれで研究を遂行した。
    法学チームは各国のAI創作デザインの法的保護の現状分析を行った。その成果は翌年度に公表予定である。また、AI創作デザインの前提となる生データ等の独占の問題について、その中心的存在となりうるデジタルプラットフォームの責任の問題も含め検討を行った。当該成果については、現在論文投稿中（査読中）である。その他、AI創作デザインとして最も容易にAI創作が可能であると考えられる画像デザインについて、現在の日本の知的財産法による画像デザインの保護についても検討を行い成果として公表した。
    デザイン学チームは、プロダクトデザインやアプリデザインなど様々なデザイン分野について、AI創作デザインに伴うデザイン概念の変化およびAI創作デザインの保護ニーズの調査を行った。また、AI創作芸術によって、芸術概念が変容しているのかの調査も行った。さらに、AIによるデザイン創作過程においてどのような技術的な問題が生じ得るのかについても調査を行った。視覚的表現を主体とする一般ユーザ向けデザイン創作においては、GAN等を利用すればよいが、一般的なデザイン創作においては必ずしも画像生成支援は必要ではない。特にデザイナーを対象としたデザイン創作支援においては、既存価値観からの脱却も重要な要素であるため汎化したDNN技術だけではデザイナーにとっては不満が残ることが明らかとなった。これら調査からデザイン創作支援において、デザイナーに特化した容易なデータセット開発手法と、画像支援にとらわれない柔軟なニューラルネットワークの設計が重要であることが明らかとなった。

    本研究課題は、アメリカ法及びイギリス法との比較法的見地から、不正競争防止法2条1項1号のもと、非類似の物品に対する形態をどのように保護すべきか、及びその保護の根拠・存在意義を明らかにするものである。申請当初の予定では、2021年度においては、前年度までにおけるアメリカLanham法43条a項や、イギリス不法行為類型Passing offのもとでの非類似の物品に対する形態保護のあり方に関する調査の結果を踏まえて、研究の取りまとめとして、不正競争防止法2条1項1号のもとでの、非類似の物品に対する形態をどのように保護すべきか、及びその保護の根拠・存在意義の検討を実施することとしていた。
    前年度においてはイギリスにおけるデザイン保護法制の一部を占める応用美術としての保護の観点からを中心として、イギリスにおけるデザイン保護について昨年度に引き続き調査、研究を実施した。そこで、昨年度の実施状況報告書において、当初の予定を変更して、依然として新型コロナウイルス感染症の影響が懸念されることから、アメリカLanham法43条a項のもとでの非類似の物品に対する形態保護のあり方に関する文献調査を実施する予定であった。
    予想した通り、新型コロナウイルス感染症の影響は依然として残存しており、加えて研究代表者の所属研究機関の変更もあったことから、研究活動の実施を可能とするための環境の整備や、必要となる資料の収集を行った。こうした中で、2021年度は、背景要因となり得るアメリカデザイン保護法制の歴史的展開を中心として調査を実施した。これに、あわせて比較検討の観点から日本の同様の制度等についても並行して調査、研究を行った。
    次年度には、前年度に調査を行ったイギリスにおけるデザイン保護及びPassing offに関して論文等を公表する予定である。そして、研究成果の取りまとめを進めることとしたい。
